Notary & Services FAQ
Why do some documents require notarization?
Notarization helps prevent fraud by verifying the identity of the person signing a document. A Notary Public confirms the signer is who they claim to be, is signing willingly, and is not under duress.
This process helps deter forgery and protects all parties involved. Some documents—such as powers of attorney, real estate forms, and affidavits—require notarization by law or by the organization receiving the document to ensure the signature can be trusted.
What types of documents get notarized?
A Notary Public can notarize many types of documents, including but not limited to:
Powers of attorney
Trusts and estate planning documents
Real estate and mortgage documents
Affidavits and sworn statements
Healthcare directives and medical forms
Financial and banking documents
Vehicle title transfers
Court and legal documents
Notarization is typically required when identity verification and an impartial witness to the signature are needed. The specific requirement usually comes from state law, a court, or the organization receiving the document.
What do I need to have to get a document notarized?
To obtain a notarization, the following are required:
A valid, government-issued photo ID (driver’s license, state ID, or passport)
The full document(s) that need notarization with appropriate state required language or certificate.
Any required witnesses or attachments (if your document requires them)
The signer must be present and able to understand and sign the document willingly.
Please do not sign the documents prior to an appointment.
Can you notarize documents from out-of-state?
Yes. A North Carolina Notary Public can notarize documents intended for use in another state.
The only requirement is that the signer must be physically present in North Carolina at the time of notarization. The document can originate from any state, and it will be notarized in accordance with North Carolina law.
Can you notarize a document in another language?
Yes. A Notary Public can notarize a document written in another language. The notarial certificate must be in English and comply with North Carolina notary requirements.
The Notary must be able to communicate directly with the signer and verify their identity, willingness, and awareness. The signer must also be able to understand the document they are signing.
What is a loan signing service?
A loan signing service provides a professional Notary Public to oversee the signing of loan documents between a borrower and a lender. The Notary ensures that all required signatures, initials, and notarizations are completed correctly, and that the borrower signs the documents willingly and in their presence.
At Triangle Notary Services, our Notaries receive specialized training in loan and mortgage documents, and they undergo annual background checks and maintain professional insurance for your peace of mind.
Can you assist me with my documents?
No. Notaries are forbidden from offering legal advice. A notary cannot review the document, explain or discuss the contents of the document or offer any kind of advice about the document.
A notary can only work within the bounds of the notarial certificate provided. If the document does not have a notarial certificate you or your attorney will need to select one, revise the document and resubmit the document for notarization.
